Associate Ryan Ellis Wins Appeal on Novel Issue in State Court
Research and writing associate Ryan Ellis obtained a favorable ruling from the Oklahoma Court of Civil Appeals on May 30, 2024, on a novel legal issue in a case litigated by partners Bill Fiasco and Tommy Gayle. The case involved medical negligence allegations against a chiropractor for treatment provided by a massage therapist in his clinic. Plaintiff failed to offer expert testimony on the standard of care for a massage therapist. The district court granted summary judgment to our client, and the Court of Civil Appeals affirmed. The issue of whether expert testimony was required under Oklahoma law on the standard of care for a massage therapist providing medical treatment had never been considered by Oklahoma appellate courts.
